DISCUSSION / BACKGROUND:

On January 8, 2019 (Item 24), the Board Approved the Introduction (First Reading) of Ordinance 5098 and Continued Ordinance 5098 to January 15, 2019 for Final Passage (Second Reading).

 

Health and Human Services Agency (HHSA) recommending the Board approve Introduction (First Reading) of a new Ordinance 4188, repealing and replacing El Dorado County Ordinance 4188, Article VIII - “Veterans Affairs Commission” Sections 2.20 2.20.510 - 2.20.570 thereby repealing and replacing Ordinance 4188 (1991).  If the Board approves the Introduction (First Reading) of Ordinance 4188, Sections 2.20.510 - 2.20.570, the Final Passage (Second Reading) will be scheduled for January 15, 2019.  

 

Upon approval of the Second Reading, the new Ordinance would become effective after thirty (30) calendar days.

 

At their meeting of Thursday, December 13, 2018, the Veterans Affairs Commission adopted draft revisions to their Bylaws.  In addition to minor typographical and grammatical corrections, the primary revisions seek to remove references to a U.S. National Guard unit represented in the County.  The U.S. National Guard unit (270th Military Police Company, Placerville Detachment) relocated its facility from El Dorado County to Madera, California in November 2014 and therefore it is no longer necessary to include the National Guard commanding officer as a non-voting member on the commission (Code Section 2.20.530(C)). 

 

The Commission also seeks to remove Section 2.20.560 (B) from the code which directs the Commission to act in an advisory capacity to the Board by “Promoting, aiding and encouraging public support and recruitment to the National Guard and Armed Forces of the United States of America.” While the Commission supports and promotes the Armed Forces and National Guard through social media and outreach, the Commission does not currently have the mechanisms in place to act in an advisory capacity to the Board of Supervisors as it pertains to the active promotion and recruitment efforts of the National Guard and other Armed Forces.

 

HHSA will bring proposed changes to the Veteran Affairs Commission Bylaws to the Board for approval after the effective date of the Ordinance change.

 

ALTERNATIVES:

The Board could decline to approve the new proposed Ordinance 2.20.510 - 2.20.570, thereby continuing to operate under Ordinance 4188.

 

PRIOR BOARD ACTION:

On November 19, 1991, Ordinance 4188 approved by the Board of Supervisors, Item 54.

It is recommended that the Board approve this item.

There is no financial impact associated with this Agenda item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will continue the agenda item to January 15, 2019 for Final Passage (Second Reading) and publish a public notice as required.

2) Upon Final Passage, the Clerk will obtain the Chairs signature on the new Ordinance, publish a public notice as required and provide a copy of the executed Ordinance to HHSA on Briw Road: Attn: Kathy Deffebach.
