Fiscal Impact/Change to Net County Cost:  The cost of this amendment is $120,000 for a total agreement amount of $240,000.  Funding for this agreement is included in the Department's Non-General Fund/CSA #10, Household Hazardous Waste FY 08/09 and 09/10 budgets.  There is no Change to Net County Costs.
 
Background:  The Environmental Management Department has utilized 21st. Century Environmental Management, Inc.  (21st Century) for hazardous waste collection, processing, transport and disposal since June 12, 2007.  The Department is requesting the Board authorize the Chairman to sign Amendment No.1 to Agreement No. 052-A-06/07-BOS increasing compensation by $120,000 to $240,000 to continue services.
 
 
Reason for Recommendation: Approval of this amendment will allow the Household Hazardous Waste Division of Environmental Management to continue the services with 21st. Century providing hazardous waste collection, processing, transport and disposal. This agreement has been in effect since June 12, 2007 and will expire on June 11, 2010.
 
The Environmental Management Department is asking the Board make findings that it is more economical and feasible to continue to utilize an outside contractor to provide the equipment and services necessary to provide hazardous waste transport and disposal services.  This outside contracting is in-lieu of the Department procuring the necessary equipment, hiring additional staff, obtaining the certification and licensing required to transport hazardous materials, and contracting with a disposal facility.
 
On May 22, 2007, item #47, the Board awarded Request for Proposal #07-961-111 for household hazardous waste transport and disposal services to Phillips Services Company (21st. Century Environmental Management, Inc. a wholly owned subsidiary of PSC) .  In accordance with Board of Supervisors Policy C-17, Sections, 7.4.2, 7.5, and 7.10, the Purchasing Agent reviewed the department's request to amend the 21st Century agreement and has determined that the competitive selection process has not expired and that outside review of the Contractor's qualifications did occur.  
 
Action to be taken following Board approval:  Upon execution by the Chair, the Board clerk's Office will forward copies of the amended agreement to the Environmental Management Department for further processing.
