Health and Human Services Agency recommending the Board:
1) Approve and authorize the Chair to sign Amendment 1 to Agreement for Services 847 with BHC Sierra Vista, Inc. doing business as (dba) Sierra Vista Hospital, Inc., for the provision of acute inpatient mental health services, for the perpetual term from June 10, 2014 until terminated, increasing the maximum obligation per fiscal year by $100,000, effective upon contract execution, for a new total obligation of $300,000 per fiscal year;
2) Make findings in accordance with County Ordinance 3.13.030 that it is more economical and feasible to contract with BHC Sierra Vista, Inc. dba Sierra Vista Hospital, Inc. for services provided under this Agreement 847 because the County has neither the staff nor facilities to perform said services; and
3) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 847, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.

DISCUSSION / BACKGROUND:
The Health and Human Services Agency (HHSA) contracts with the State Department of Health Care Services (DHCS) to serve as the Mental Health Plan (MHP) for the County. HHSA, as the MH, contracts with multiple inpatient acute psychiatric hospital facilities to ensure availability of services, on an “as needed” basis, in accordance with Exhibit E, Attachment 1 of the MHP Agreement (3190), and per 42 Code of Federal Regulations Section 438.2.
On June 10, 2014, the Board of Supervisors approved perpetual Agreement 847 (447-S1311; File ID No. 14-0698; Agenda Item 68) with BHC Sierra Vista for acute inpatient mental health services for medically indigent County residents and County Medi-Cal clients.
Based on historical usage and current trending of utilization, the maximum obligation of $200,000 per fiscal year for Agreement 847 with BHC Sierra Vista is insufficient to meet the needs of the community. Therefore, this Amendment 1 includes an increase of $100,000 per fiscal year, bringing the new maximum obligation to $300,000 per fiscal year.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA would continue to provide services through existing contracts with other vendors, which would limit HHSA’s capacity for these services.

It is recommended that the Board approve this item.
FINANCIAL IMPACT:
This Amendment increases the maximum obligation of this perpetual Agreement by $100,000 per fiscal year, bringing the new total to $300,000 per fiscal year. The Agreement continues to be funded with 1991 and 2011 State Mental Health Realignment, therefore, there is no Net County Cost associated with this Agenda item. Sufficient appropriations were included in the fiscal year 2018-19 budget, and will be included in future budgets for the term of the Agreement.
