Background:
Assembly Bill 2766 (Sher) authorized air pollution control districts to impose up to a $4 motor vehicle registration fee to provide funds for air districts to meet responsibilities mandated under the California Clean Air Act.  On March 15, 1994, by Board Resolution #79-94, the AQMD set the fee at $4 per registered motor vehicle.
 
The California Health and Safety (H&S) Code states that the fees shall be used to reduce air pollution from motor vehicles and for related planning, monitoring, enforcement and technical studies necessary to implement the California Clean Air Act.  The California Air Resources Board (CARB) has published a guidance document titled "Proposed Criteria and Guidelines for Use of Motor Vehicle Registration Fees.
 
Reason for Recommendation:
On January 19, 2009, the AQMD issued a Request for Proposal (RFP) for Motor Vehicle Emission Reduction Projects.  A total of eight (8) proposals were received.  Three (3) of the proposals also included a request for alternative (lower) funding.  All proposals and their alternatives were reviewed for eligibility, evaluated for cost effectiveness and ranked per the "Evaluation Criteria and Selection Process" guidelines detailed in the RFP.   The sum of requested funding for eight (8) eligible projects (with or without alternative funding requests considered) significantly exceeded the available AB2766 DMV fees FY09/10 budget of $380,000.  In order to remain within budget an additionall evaluation was conducted for the purpose of developing a feasible option of reduced or no funding for certain project(s) .  Each eligible project was objectively assessed for its cost effectiveness, the requested funding amount, and potential benefits for the community.  Following this additional evaluation, the AQMD recommends full funding for seven (7) eligible projects and no funding for the EDC DOT Hwy 49 Class I Bikepath project, due to its overall low effectiveness ranking and the fact that its requested funding exceeds 50% of the available budget.  This recommended funding option, developed to maximize use of the AB2766 DMV fees for air quality improvements and community benefits, is summarized in the attached Table.
 
 
Action to be taken following Board Approval:  
Board Clerk to provide executed Agreements to the AQMD for further processing.
