Fiscal Impact/Change to Net County Cost:
The Transportation Department (Department) included $254,630 in its Fiscal Year 2009-2010 budget and anticipates budgeting the remaining amount in subsequent fiscal years.  Funding for the traffic control and enforcement services has been included in the individual budgets for Capital Improvement Program (CIP) projects and will be from Traffic Impact Mitigation (TIM) Fees and State and Federal CIP project funding.  There is no Net County Cost.
 
Reason for Recommendation:
The Department is requesting approval of the subject Agreement with the State of California - Department of California Highway Patrol (CHP) for a three-year term and a not-to-exceed compensation amount of $500,000 for traffic control and enforcement services, based on proper advance notification, during construction phases of various CIP construction projects within and in the vicinity of El Dorado County.  The major multi-year projects for which the Department anticipates requesting services under the proposed Agreement include the ongoing U.S. 50 HOV Lanes, Phase 1 - El Dorado Hills to Bass Lake Grade Project and the upcoming Missouri Flat Road Overcrossing Phase 1B Project and U.S. 50 HOV Lanes, Phase 2 - Bass Lake Grade to Cameron Park Drive Project.
 
To ensure safety on CIP construction projects, traffic control and enforcement services are sometimes necessary within and near the limits of the construction area.  These services are required during specified stages of work, including detours and blasting operations, to control and allow for the safe movement of public traffic within the construction area.
 
Although the El Dorado County Sheriff's Department (Sheriff's Department) has classifications that could perform these types of services, the construction activity often takes place within the State of California's right-of-way, outside of the Sheriff's Department jurisdiction, making traffic control in those areas the responsibility of the CHP.  If a project does occur in a location that is within the jurisdiction of the Sheriff's Department, nothing in the Agreement precludes the use of the County's own resources, should they be available.
 
Pursuant to the El Dorado County Charter, Article II, Section 210 b (6), the County may enter into any contract or agreement in cases where the agreement is with or among any other governmental entities or agencies.  The services to be performed by the CHP require skills that are expressly identified in County job classifications, but because of possible jurisdictional issues, County employees would not be able to perform the requisite services at all of the locations that may require traffic control services.  The services to be provided under this Agreement are temporary and sporadic in nature.
 
In accordance with the Feasibility Analysis, the Department is not required to notify an employee's association regarding this Agreement.
 
Action to be taken following Board approval:
1.  The Board Clerk will obtain the Chairman's signature on the two (2) originals of the Agreement and return them to the Department.
2.  Upon receipt of the two (2) originals of the Agreement, the Department will forward both originals to the CHP for signature.
3.  Upon receipt of the fully-executed original Agreement from the CHP, the Department will forward it to the Board Clerk and retain a copy for its files.
