On March 12, 2019, the Clerk was made aware of a provision in the Evelyn Horn Scholarship Trust document that states the Board Chair shall be from a District which constitutes a major portion of the Western Slope of the County. DISCUSSION / BACKGROUND
Pursuant to the language in the Evelyn Horn Scholarship Committee Trust document, the Board Chair is directed to serve as a member of the committee. The operative provision in the Trust document states in full: "The Chairman of the Board of Supervisors of El Dorado County, provided that said Chairman is from a District which constitutes a major portion of the Western Slope of El Dorado County, and if the Chairman is not from the Western Slope, then a member of the Board of Supervisors determined by a majority vote of the Supervisors whose District is primarily located within the Western Slope of El Dorado County."
The Clerk was made aware of this provision on March 12, 2019. As the borders of Supervisorial District 5 lie primarily on the eastern portion of the County and South Lake Tahoe basin, the Clerk finds that it is prudent for the Board to appoint a member from any of the other four Districts to serve on this committee to achieve compliance with the language in the Trust.
