DISCUSSION / BACKGROUND

As authorized by Section 182.6(g) of the Streets and Highway Code, El Dorado County Transportation Commission (EDCTC) has entered into Agreements X14-6157(050) and X15-6157(054) with the California Department of Transportation (Caltrans) to assign a defined portion of its annual Regional Surface Transportation Program (RSTP) Exchange Funds apportionment to Caltrans in exchange for Fiscal Year (FY) 2013-14 and FY 2014-15 nonfederal State Highway Account Funds.  EDCTC is authorized to use these Exchange Funds to assist local agencies in promoting projects which otherwise qualify for RSTP funds.  EDCTC is required to execute formal written agreements between EDCTC and RSTP Exchange Recipients and provide oversight of the program funds.  The EDCTC Board approved the allocation and payment of FY 2013-14 funds on June 19, 2014, and the allocation and payment of FY 2014-15 funds on December 3, 2015, calculated per the formula-based distribution policy adopted by EDCTC on February 3, 2011.  The expiration date of the funds is five (5) years from the date funds are allocated by the EDCTC.

 

On November 17, 2015, Legistar 15-1092, Item 24, the Board approved Agreement between EDCTC and El Dorado County for FY 2013-14 and FY 2014-15 RSTP Exchange Funds allocating a total of $849,358 for the County's use, including $349,358 for Bucks Bar Road at North Fork Cosumnes River-Bridge Replacement Project 77116; $300,000 for County-wide road rehabilitation and maintenance materials and activities; and $200,000 for the Newtown Road at South Fork of Weber Creek-Bridge Replacement Project 77122.

 

The RSTP Agreement allows for an amended project list.  On June 28, 2016, Legistar 15-1092, Item 30, the first amendment was approved by the Board which decreased funding for the Bucks Bar Road Bridge Project by $334,901.46, increased funding for the Newtown Road Bridge Project by $173,933, and added the U.S. 50/Camino Area Safety Project 71319 for $160,968.46.  Funding for the Bucks Bar Road Bridge Project was available from Traffic Impact Mitigation fees.

 

The Second Amendment amends the project list for X14-6157 (050) by decreasing funding to $73,076.41 for 71319 US 50/ Camino Area Safety Project and increasing funding for 46100/ 49307 Road Rehab to $338,706.05.  The Second Amendment also amends the project list for X15-6157 (054) by decreasing funding to $0.00 for 71319 -US 50/ Camino Area Safety Project and increasing funding for 72197 Intersection Safety / Sight Triangle Improvement Project to $49,186.00.

 

ALTERNATIVES

The Board could choose not to approve this Amendment and the project funding list would not change. However by approving the revised project lists and allocations, the County is better able to leverage funding to assist with the delivery of various capital improvement projects.

EDCTC, County Counsel, and Risk Management have reviewed and approved the Second Amendment.

 

CAO RECOMMENDATION / COMMENTS

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Approval of this Second Amendment will reallocate funding to eligible projects with no change to net County cost.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Second Amendment.

2) The Clerk of the Board will forward the two (2) partially-executed original Second Amendments to Transportation, Fairlane Engineering, attention Matt Smeltzer, for further processing.
