Fiscal Impact/Change to Net County Cost:
The Transportation Department (Department) included $75,000 for each Agreement in its Fiscal Year (FY) 2009/2010 budget and anticipates budgeting the remaining amounts in subsequent Fiscal Years.  The final cost is recovered through restricted sources that fund the Department's Capital Improvement Program (CIP) projects, including the Traffic Impact Mitigation Fee Program, the Regional Surface Transportation Program, the Highway Bridge Program and federal aid funds, and by developer impact fees.  There is no Net County Cost.
 
Background:
The Procurement and Contracts Division conducted a Request for Qualifications (RFQ) process for the Department in 2007.  The Department utilized this RFQ process, which included a review of each vendor's qualifications by an outside reviewer.  With approval from the Procurement and Contracts Manager, on October 16, 2008 the Department sent out a Request for Proposals (RFP) to the top three consultants on the Geotechnical Engineering RFQ shortlist to provide professional geotechnical and geological engineering support services, including materials testing and geotechnical investigation, analysis and recommendations on CIP projects, subdivision projects, and emergency work during the 2009, 2010, and 2011 construction seasons.  These projects are located on the County's West Slope and in the Tahoe Basin.  
 
The evaluation and selection process was conducted in November 2008.  A consultant selection committee consisting of Department senior staff evaluated each firm's qualifications for the level of expertise required to perform specific criteria.  Holdrege & Kull, Consulting Engineers and Geologists (Holdrege & Kull) and Kleinfelder West, Inc. (Kleinfelder) are two of three consultants chosen to provide the appropriately skilled and experienced staff and the unique equipment necessary to accomplish the complex and essential services needed on the Department's construction projects.  In February the Board approved an agreement with the third consultant, Youngdahl Consulting Group, Inc.
 
Reason for Recommendation:
The Department's Construction Division supports the CIP and developer built highway improvements.  During the term of these Agreements, the Department will have a continued need for soils investigations, specialized materials inspections and materials testing to support upcoming projects.  The disciplines required for the services to be performed under these Agreements include geotechnical, geological, environmental, and construction engineering skills, as well as quality assurance testing of materials and concrete, structural section core sampling and design recommendations, Resistance "R" value analysis, foundation analysis, reports and design recommendations, fugitive and asbestos dust monitoring/mitigation, groundwater investigations, slope stability analysis, subsurface exploration, test bore core sampling and logging, geologic field mapping and report preparation, and specialized inspections for welding, concrete, asphalt and soils.
 
The Department has some staff skilled in the basics of materials testing; however, the majority of the services require skills that are not expressly identified in County job classifications.  In addition to providing expert and experienced staff, both Holdrege & Kull and Kleinfelder supply the appropriate specialized equipment necessary to perform the work.
 
The need for expertise in specialty services at both the design and construction phases of the Department's projects and the need for materials testing make it necessary to supplement our available resources.  The Department's current laboratory staff does not have the equipment or the expertise necessary to perform all the tasks that are required to accomplish the testing necessary for the construction season workload.  The Department will administer these Agreements on a Task Order basis to the extent that the Department deems it necessary to augment its current staffing levels.
 
The Department requests the Board make findings pursuant to Article II, Section 210 b (6) of the El Dorado County Charter that there are specialty skills required for the work performed under these Agreements that are not expressly identified in County classifications.
 
In May 2009 the Department requested and received concurrence from the Purchasing Agent that a competitive selection process occurred and that the selection process has not expired.  The outside reviewer concurs that Holdrege & Kull and Kleinfelder are qualified and able to perform the geotechnical and geological engineering support services.  These Agreements are in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
The El Dorado County Employees Association, Local #1, has been informed of these proposed Agreements.
 
Action to be taken following Board approval:
1)  The Chairman will sign the two (2) originals of Agreement for Services # AGMT 08-52558 with Holdrege & Kull.
2)  The Chairman will sign the two (2) originals of Agreement for Services # AGMT 08-52559 with Kleinfelder.
3)  The Board Clerk will forward one (1) original of each of the fully-executed Agreements to the Department for further processing.
