Fiscal Impact/Change to Net County Cost:
The recommended action will provide a portion of the funding removed from the Department's proposed budget for 2009/10.
 
Background:
As a result of declining revenues and the uncertainty of receiving State mandated reimbursements the County continues to face serious economic hardships, necessitating reductions in expenditures.  A mandatory temporary layoff will help achieve savings through a reduction in employees' hours worked.  
 
Reason for Recommendation:
The FY 2009/10 budget was constructed to include a 10 day Mandatory Temporary Layoff countywide.  During budget workshop discussions, the decision was made to allow each department head to determine the most appropriate way to achieve the "value" of the implemented reductions within their respective departments.  
 
At this time, the Chief Probation Officer has determined employees within the Probation Department, with the exception of the staff of the Juvenile Detention Facilities (JDF) classifications listed below, should take three days of Mandatory Temporary Layoff, equivalent to 24 hours for full-time employees or 12 hours for employees working 40 hours or less per pay period, on or before June 30, 2010.  In order to mitigate the impact on the Court, the three furlough days shall coincide with Superior Court Holiday dates already scheduled for office closure.  These dates are:
 
      Columbus Day, Monday, October 12, 2009
      Lincoln's Birthday, Thursday, February 12, 2010
      Cesar Chavez Day, Wednesday, March 31, 2010
      
Per Title 15 of the California Code of Regulations JDF staff are exempt from Mandatory Temporary Layoff; the JDF staff include the following classifications: Supervising Deputy Probation Officers-Institutions, Sr. Deputy Probation Officers-Institutions, Deputy Probation Officers I/II-Institutions, Correctional Food Services Supervisor, Correctional Cook, and Administrative Secretary.  
 
Probation Department will work with Human Resources to meet and confer with the affected bargaining groups regarding this program.  
 
Action to be taken following Board approval:  
1.  Chairman to sign Resolution.
2.  Forward copies of the signed Resolution to Human Resources and Probation for  implementation.
