DISCUSSION / BACKGROUND
SCAAP provides federal payments to states and localities that incurred correctional officer salary costs for incarcerating undocumented criminal aliens with at least one felony or two misdemeanor convictions for violations of state or local law, and incarcerated for at least 4 consecutive days during the reporting period. The Sheriff's Office receives between $15,000 - $40,000 in funding from SCAAP each year to offset salary costs related to care for these inmates. In FY 2019-20 the Sheriff's Office budgeted $14,189 but received $28,321 in revenues. Due to an increase in Federal Appropriations, which has risen since FY 2017 ( $210M in FY 2017, $240M in FY 2018, $240M in FY 2019 and $260M in FY 2020), El Dorado County received $28,321 in SCAAP funding which is more than anticipated. The revenue we have observed in FY 2019-20 is based on the FY 2018 Grant award. The funding received varies due to Federal Appropriations and State Criminal Alien inmates housed in El Dorado County Jails.

The federal Department of Justice is requesting that a resolution (by title and not name) be on file from public agency governing bodies authorizing its agents to execute for and on behalf of that public agency applications for federal grant funds. The Governing Body Resolution will be required to be brought back to Board three (3) years from the date of execution for this resolution.

ALTERNATIVES
Failure to provide this resolution to the State would disallow the Sheriff's Office from accepting grant awards from the federal Department of Justice relating to SCAAP.
