Fiscal Impact/Change to Net County Cost:  There is no change in Net County Cost.  Revenue generated by this fee is a direct pass through to the State of California Environmental Protection Agency.
 
Reason for Recommendation:
California Assembly Bill 2286 was recently signed into law on June 26, 2009.  This Assembly Bill made changes to the California Health and Safety Code now requiring all businesses subject to hazardous materials regulations to electronically submit their hazardous materials regulatory reports to the CUPA's by 2013.  The Environmental Management Department is the CUPA for the County of El Dorado.
 
To fund the creation of an electronic data reporting system, the California Environmental Protection Agency (Cal EPA) Secretary has initiated an increase to the Hazardous Materials oversight surcharge collected by the CUPA's.  The increase imposed by the Cal EPA is $25.00 an increase from $24.00 to $49.00 for fiscal years 2009/2010 through 2011/2012 ((3) fiscal years).  As with the existing surcharges, once collected these funds will be remitted to the State of California.  
      
The hearing to adopt the proposed increase in CUPA State of California Surcharge has been duly noticed in accordance with Section 6066 of the California Government Code.
 
 
Action to be taken following Board approval: Forward executed resolution to Environmental Management Department for implementation.
