Fiscal Impact/Change to Net County Cost:
There is no fiscal impact from the proposed Amendment. There is no cost to the County General Fund associated with this Amendment.
 
Background:
On December 12, 2006, the Board of Supervisors approved the Road Improvement Agreement for  improvements to Blackstone Parkway, Royal Oaks Drive, Pavilion Drive and Cornerstone Drive, collectively referred to as the West Valley Collector Roads. The Department of Transportation (Department) received a request to extend the performance time for completion of this work to December 9, 2009.   
 
Reason for Recommendation:
While the majority of the work required under this Agreement has been completed, several items remain to be completed. This Agreement should, therefore, remain in effect until all work has been completed.
 
The Developer has assured the County that they have not abandoned the project, however, due to current market conditions, the anticipated absorption rates have slowed substantially. The Developer continues to work with the Department to finalize agreements for landscaping, walking and bicycle path improvements.
 
Action to be taken following Board approval:
1. The Chairman will sign two originals of the First Amendment to Road Improvement Agreement # AGMT 06-1216 with West Valley, LLC. and return them to the Department.
