DISCUSSION / BACKGROUND
Department of Transportation (Transportation) has been following California Department of Transportation’s (Caltrans) Local Assistance Procedures Manual (LAPM) Chapter 10, Consultant Selection, for all projects that utilize state and federal funds. Chapter 10 of the LAPM outlines the policies and procedures for the procurements and management of contracts for engineering and design related consultant services Architectural & Engineering (A&E) contracts on federal and state funded transportation projects to ensure compliance with applicable Federal and State laws and regulations. Caltrans has recently suggested that Chapter 10 be formally adopted by our Board through a Resolution. Chapter 10 is usually revised every year and Caltrans is continuously advising of the changing laws and regulations from the Federal Highway Administration. One way that Caltrans ensures that Transportation complies with Chapter 10 is to require that Exhibit 10-C A&E Consultant Contract Reviewers Checklist be completed and approved by Caltrans A&E Oversight unit. One of the requirements is that Transportation formally adopts Chapter 10 or Caltrans approves Transportation’s own procedures. Transportation requests to formally adopt Chapter 10 by Resolution since this has been Transportation’s procedure. Even with the adoption of LAPM Chapter 10, Transportation will continue to abide by the County’s Procurement Policy and any other applicable local, state, or federal law, regulation, or policy governing a particular procurement of services.
ALTERNATIVES
The Board could choose not to adopt the Resolution; however, this could jeopardize future state and federal funding if Transportation does not comply with LAPM Chapter 10.

1) The Clerk of the Board will obtain the Chair’s signature on the original Resolution.
2) The Clerk of the Board will forward one (1) copy of the executed Resolution to Transportation, Fairlane Engineering, attention Matt Smeltzer.
