DISCUSSION / BACKGROUND

As part of El Dorado County (County) meeting the State of California readiness criteria in containing COVID-19 and the current accelerated Stage II designation for the County approved by the state, El Dorado Irrigation District (EID) is re-opening Sly Park Recreation Area (SPRA) at Jenkinson Lake for local, in-county residents for restricted uses. After consultation with the Chief Administrator’s Office and the County Public Health Officer regarding re-opening, EID has requested to have an increased Sheriff's Office presence within SPRA in order for EID to ensure a safe, enjoyable experience for El Dorado County residents. Under the proposed agreement, EID would pay the County to provide a dedicated, uniformed deputy and patrol vehicle to be present within SPRA during peak use hours on weekends and holidays. This service would be in addition to the ongoing service provided by the Sheriff’s Office to EID and all County residents through regular vehicle patrols, dispatch response for service, and occasional boat patrols within SPRA.  A contract for supplemental law enforcement services has been submitted and approved by County Counsel and due to the short time frame, services were provided before Board approval was received.  Board approval will ratify the contract.  The Sheriff's Office will be charging EID , the actual overtime costs of the Patrol Deputy providing the supplemental law enforcement service up to $81.55 per hour, which is the cost of a fully burdened , top step Deputy overtime rate.  An administrative fee of twelve percent will also be required to be paid.

California Government Code § 53069.8 provides the board of supervisors of any county may contract on behalf of the sheriff of that county to provide supplemental law enforcement services to :

(1) Private individuals or private entities to preserve the peace at special events or occurrences that happen on an occasional basis.

(2) Private nonprofit corporations that are recipients of federal, state, county, or local government low-income housing funds or grants to preserve the peace on an ongoing basis.

(3) Private entities at critical facilities on an occasional or ongoing basis. A “critical facility” means any building, structure, or complex that in the event of a disaster, whether natural or manmade, poses a threat to public safety, including, but not limited to, airports, oil refineries, and nuclear and conventional fuel powerplants.

(4) Private schools, private colleges, or private universities on an occasional or ongoing basis.

 

In addition, California Government Code § 6502 allows the governing bodies of two public agencies to enter into an agreement to jointly exercise any power common to the contracting parties.  This would include agreements in which the Sheriff agrees to provide supplemental law enforcement services to another public entity, including cities, special districts, and school districts.
