Fiscal Impact/Change to Net County Cost:  There is no increase in net County cost.  The funds expended will be reimbursed by the applicants for the projects through an Agreement For Payment of Processing Fees executed by the property owner at the time the permit application is submitted.  
 
Background:  On July 1, 2006, Development Services Department assumed the commercial grading functions from the Department of Transportation.  After a competitive selection process was conducted, the Board of Supervisors approved Agreement for Services 156-S0711 with Dokken Engineering on August 22, 2006 for an amount not to exceed $30,000 to provide commercial grading plan review on an "as requested" basis.  On August 14, 2007, the Board of Supervisors approved Amendment I, which provided for a one-year extension of the term, to expire August 22, 2008, and an increase in compensation of $60,000.  On August 19, 2008, the Board of Supervisors approved Amendment II, which provided for a one-year extension of the term, to expire on August 20, 2009, and an increase in compensation of $40,000.  This amendment will extend the agreement for a third year and adds an additional $50,000 to the Agreement for an amount not to exceed $180,000, inclusive of all expenses.
 
It should be noted that there is a system in place between the Department of Transportation (DOT) and Development Services whereby DOT is given the opportunity to perform these engineering plan checks if they have the staffing to do so.  If not, the commercial grading plan review is contracted out on an "as requested" basis.
 
The County Purchasing Agent has determined that it is more appropriate to amend this contract versus initiating a new one, in accordance with Board of Supervisors Policy C-17, Section 7.4.2.  This Department has coordinated outside review of the Contractor's qualifications.  The outside reviewer concurs that the Contractor is qualified and able to perform the needed services.  On July 7, 2009, the contract was sent to El Dorado County Employees Association, Local #1, from whom no objections to the contract were received.
 
Reason for Recommendation:  Under this agreement, contractor provides plan review services on an "as requested" basis.  During peak seasonal periods, the Department requires the availability of on-call services to assist with plan reviews and ensure the timely review of plans and issuance of permits.  Without the availability of on-call services during peak periods, a backlog of projects would develop resulting in delays that would negatively impact customer service and cause delays to projects.  Due to the seasonality and sporadic nature of this need, it is neither feasible nor economical to recruit staff to complete these tasks.
 
Action to be taken following Board approval: The Board Clerk will provide one fully-executed original Amendment to Development Services for further processing.
