Fiscal Impact/Change to Net County Cost:
There is no net cost to the County General Fund associated with this agenda item.
 
Background:
Section 182.6 of the Streets and Highways Code authorizes the TRPA to exchange the assigned Federal apportionments made available to TRPA under the Safe, Accountable, Flexible, Efficient, Transportation Equity Act - A Legacy for Users (SAFETEA-LU), Regional Surface Transportation Program (RSTP), for nonfederal State Highway Account funds.   Through Agreements [Agreement numbers: X03-6125(016), X04-6125(017), X05-6125(019), and X06-6125(020)] pursuant to Section 182.6 of the Streets and Highways Code, between Caltrans and TRPA, these funds have been exchanged for a like amount of State funds. TRPA has accumulated these funds over prior period funding cycles and the activities proposed by the Transportation Department meet their funding criteria.    
 
In order for El Dorado County to receive these exchanged funds from TRPA, an Exchange Fund Transfer Agreement between TRPA and El Dorado County is needed to transfer the State funds.  The funds will be used within the Tahoe Engineering Division Environmental Improvement Program for the Lake Tahoe Boulevard Bike Trail Project (JN 95186) and for the Sawmill 2 Bike Path Project (JN 95165).
 
Reason for Recommendation:
This recommended action will allow the Tahoe Engineering Division (TED) to receive $300,000 of State revenue through the TRPA.  $42,000 of these RSTP exchange funds are included in the current FY 2009-10 DOT-TED Budget.  The remaining $258,000 will be included in the FY 2010-11 budget and is included within the 5 year Capital Improvement/Environmental Improvement Program for TED.  However, these FY allocations are subject to change based on the current State financial issues.
 
Action to be taken following Board approval:
1. The Board Chairman to sign two (2) copies of the Exchange Fund Transfer Agreement with the TRPA.
2. Board Clerk's Office to return two (2) signed original Agreements to Department.
3. Department will forward both Orginal Agreements to TRPA for signature and upon return of one (1) signed Agreement DOT will forward to Board Clerk.
4. Department will prepare an invoice to obtain the available funding.
