Probation Department recommending the Board:
1) Make findings in accordance with El Dorado County Ordinance Code, Chapter 3.13.030 (E) that diagnostic studies, treatment services, and temporary detention services with The California Department of Corrections and Rehabilitation, Division of Juvenile Justice (CDCR/DJJ), is work with a governmental entity or agency;
2) Approve and authorize the Chief Probation Officer, or designee, to sign Agreement C5609531(FENIX 4954) with CDCR/DJJ to allow services of diagnostic studies, treatment services, and temporary detention for delinquent youth referred in Juvenile Court. This Agreement is for a term beginning upon full execution and expiring on June 30, 2023, for a not to exceed amount of $361,260; and
3) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement C5609531 (Fenix 4954) including future amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.

DISCUSSION / BACKGROUND
The California Department of Corrections and Rehabilitation, Division of Juvenile Justice (CDCR/DJJ) agrees to provide diagnostic studies, treatment services, and temporary detention for delinquent youth referred from Juvenile Court to the County of El Dorado. The County of El Dorado agrees to compensate the CDCR/DJJ, for services performed at CDCR/DJJ facilities.
A Juvenile Court determines if a delinquent youth is eligible for commitment to the CDCR/DJJ, in any county in which there is a contract in effect, pursuant to Section 1752.1 and Section 1731.6 of the Welfare and Institutions Code (WIC). The Juvenile Court also determines if a delinquent youth is eligible for commitment by ensuring the youth falls within the provisions of WIC Section 1731.5, and concludes that a proper disposition of the youth’s case requires such observation and diagnosis as can be made by the CDCR/DJJ.
The CDCR/DJJ contract allows for the Juvenile Court to order a youth to the CDCR/DJJ's 90-day diagnostic commitment. Probation has identified a need to fulfill the contract with CDCR/DJJ to allow eligible and appropriate youth to benefit from diagnostic services by obtaining treatment necessary to assist with personal growth, community safety, and reducing recidivism.
Probation has been using CDCR/DJJ for Juvenile Court-referred youth services since 2006.
For Fiscal Year 19/20, Probation has spent $19,847 and is not projecting any additional expenses through June 30, 2020. The Department has reached out to CDCR/DJJ in anticipation of how Governor Newsom's proposed realignment will affect our Department. They will accept youth through December 31, 2020, however the situation is extremely fluid and Probation is requesting to keep the contract term of 3 years, pending further information from the State of California. Realignment of CDCR/DJJ services will take months of planning and coordination prior to any decisions being finalized.
