Fiscal Impact/Change to Net County Cost:  Hearings are funded through fines collected in the Dangerous Building Abatement fund and are included in the Department's FY 2009-10 budget.
 
Background: The appointment of a Code Enforcement Hearing Officer, by Resolution, is consistent with Board priorities and policies related to compliance with County Codes, cost recovery and its vision to provide effective regulation while offering an efficient method for citizen appeal.
 
Hearings are generally held twice each month, on the first and third Wednesdays, at a cost of $180 per hour as compensation for the Hearing Officer, plus the cost for additional time spent towards rendering decisions(s). Fines collected in the Dangerous Building Abatement fund are utilized to fund these hearings.
 
Reason for Recommendation:The appointment of a Code Enforcement Hearing Officer will facilitate a cost-effective and efficient administrative process for the appeal of a regulatory penalty that has been imposed. There is also the potential for use of this hearing process by other County departments and other programs enforced by the Code Enforcement Division including code enforcement of the Vacation Home Rental Ordinance.
 
William M. Wright is well qualified to serve as Code Enforcement Hearing Officer.  Mr. Wright is a licensed attorney.  Since May 2008, he has served as Animal Services Hearing Officer for El Dorado County Health Services Department.
 
Action to be taken following Board approval:  1) Board chairman to sign 2 copies of agreement for services and return one copy to Development Services for processing. 2) Board chairman to sign 2 copies of resolution appointing a code enforcement officer and return one copy to Development Services.
