Fiscal Impact/Change to Net County Cost:
Funding for services under Agreement for Services AGMT 09-52715 will be provided by benefit assessments or special taxes for the zones of benefit where services are provided. There will be no cost to the General Fund or the Road Fund.
 
Reason for Recommendation:
The Department of Transportation is responsible for administration of 101 zones of benefit in the County.  Thirty-two of the zones were formed for maintenance of roads that have not been accepted into the County Maintained Mileage System.  Road maintenance work is performed by contractors and not by County forces in these zones.  
 
In an effort to increase efficiency and reduce costs to these road zones of benefit, Department of Transportation staff recently requested direction from County Counsel regarding bidding and contracting processes for routine road maintenance in these types of zones.  After review of the zone of benefit work program and the types of work commonly performed, Counsel advised that much of this work meets the definition of "maintenance" which is not subject to the bidding requirements of the Public Contract Code, but is instead subject to the County's general procurement procedures.
 
The result is that as-requested routine maintenance contracts may be set up to accommodate the on-going road maintenance needs of the zones of benefit instead of numerous individual project contracts for the same work in different zones.  Under this type of agreement, work will be authorized for individual zone of benefit projects through a Work Order issued by the County's Contract Administrator.  The benefit of this approach is that the cost for contract preparation is reduced and the agreement is in place for zones of benefit to use when it is most beneficial to have the work performed.  
 
This summer, the Department of Transportation received three contract requests for micorsurfacing. In order to realize efficiencies in contract processing, staff has prepared this as-requested contract for a not-to-exceed amount of $100,000. This amount will accommodate all of the work under one contract.   
 
The Department may elect to solicit bids prior to entering into an as-requested maintenance contract, even if not required under the County's procurement procedures, if it would be in the best interest of the zones to do so.  
 
County staff does not perform work on zone of benefit roads that are not included in the County Maintained Mileage System; therefore, notification to the El Dorado County employee bargaining units of this Agreement is not necessary.
 
Action to be taken following Board approval: The Board Chairman will sign two originals of Agreement for Services AGMT 09-52715; and the Board Clerk will forward one original of the fully executed Agreement to the Department of Transportation for further processing.
