DISCUSSION / BACKGROUND
On May 22, 2018 (Item 21), the Board approved the Offsite Road Improvement Agreement (RIA) for North Silver Dove Way, TM 00-1371-R / TM 00-1371-E, Agreement #18-54823, with Lennar Winncrest, LLC (Developer). The RIA defined the obligations of the Developer for the performance of the work within the County Right of Way.

Resolution 96-95 authorizes the Department of Transportation (Transportation) director to sign a one-time, twelve (12) month extension of improvement agreement performance periods. However, due to staffing transitions and a higher than normal workload, processing of this amendment was delayed which resulted in a lapse of the performance period. In order to correct the lapse, staff is requesting a one (1) year performance period extension to extend the performance period to May 21, 2021. Since the performance period extension exceeds the authority of the Transportation director under Resolution 96-95, Transportation is bringing the Amendment to the Board for approval.

The construction of this subdivision is substantially complete; however, the Developer needs to be within the performance period of the agreement in order to complete any remaining items and finalize the project. Transportation requires a valid performance period at project completion.
