DISCUSSION / BACKGROUND

The Political Reform Act requires every local government agency to adopt a conflict of interest code and to review, and revise if necessary, its conflict of interest code every two years.  Under state law, the Board of Supervisors is identified as the “code reviewing body” with the responsibility to review and approve the local agencies’ revised conflict of interest codes.  

 

The following local public agencies have submitted their revised conflict of interest codes for County review and Board approval: Diamond Springs/El Dorado Fire Protection District (Attachment A), El Dorado Hills Community Services District, (Attachment B), Marble Mountain Community Services District (Attachment C), Showcase Ranches Community Services District (Attachment D), El Dorado County Office of Education (Attachment E), El Dorado Hills County Water District (Attachment F), Mosquito Fire Protection District (Attachment G), Happy Homestead Cemetery District (Attachment H), Greenstone Community Services District (Attachment I), and Camino Union School District (Attachment J).

The revised conflict of interest codes reflect updates that are necessary to align with the local public agencies’ changes to positions and overall organizational structure.  County Counsel has reviewed the updated conflict of interest codes submitted by these agencies, finds that they are in accordance with state law, and recommends that the Board approve the revised codes as submitted.  The Board’s approval makes the revised codes legally effective.

The following local agencies have indicated that they are in the process of reviewing and updating their conflict of interest codes and the Elections Department will follow up with them for submittal of their revised codes: Georgetown Fire Protection District and El Dorado Resource Conservation District.

Other local government agencies have indicated they have reviewed their existing conflict of interest codes and do not wish to make any changes to them.  These local conflict of interest codes are not part of this agenda item. Those agencies will be governed by their former adopted and approved codes until such time as a new amended code is submitted, reviewed and approved by the Board of Supervisors as the code reviewing agency.

ALTERNATIVES

If the Board does not approve the attached revised conflict of interest codes, these agencies will be governed by their former adopted and approved codes that do not reflect changes to the designated positions and disclosure categories.

 

PRIOR BOARD ACTION

On December 11, 2018 Legistar item # 18-1822, the Board reviewed and approved the revised conflict of interest codes received from local public entities within the County.
