Title

Surveyor's Office recommending the Board adopt and authorize the Chair to sign Resolution 207-2021 for Abandonment of Easement 20-0005, to abandon slope, public utility and drainage easements on Lot 7 of Barnett Business Park, recorded in Book G of Subdivisions at Page 49, identified as Assessor's Parcel Number 109-401-002, within the community of Shingle Springs, Supervisorial District 2.

DISCUSSION / BACKGROUND

A request has been submitted by DLLM, L.P., a California limited partnership, owner of Assessor's Parcel Number 109-401-002, requesting that the County of El Dorado, Board of Supervisors, vacate slope, public utility and drainage  easements located on said property. Subject easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution. 

 

The slope, public utility and drainage  easements, as shown on Lot 7 of Barnett Business Park, recorded in Book G of Subdivisions at Page 49, were offered to the County of El Dorado by Joe Vicini Inc. a California Corporation and KFRD Investments, Inc. a California Corporation, on September 23, 1986. The easements were acknowledged and accepted by the County of El Dorado on September 30, 1986, and the Subdivision Map was recorded on October 1, 1986.

 

ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 20-0005. By utilizing this alternative, the owner of Assessor's Parcel 109-401-002, would be unable to pursue any development that would impact subject easements.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District, Pacific Gas & Electric and the El Dorado County Department of Transportation have not used said portion of subject easements for the purpose for which they were dedicated and find no present or future need exists for said portion of subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

 

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor's Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
