Fiscal Impact/Change to Net County Cost:  None.  This is the filing of the annual Equitable Sharing Agreement and Certification to the Department of Justice for the revenues and expenditures in Fiscal Year 2008/09.
 
Background:   The Federal Equitable Sharing Agreement is entered into among the (1) Federal Government; (2) the El Dorado County Sheriff; and (3) the governing body of the county, and sets forth the requirements for participation in the Federal Equitable Sharing Program and the restrictions upon the use of federally forfeited cash, property, proceeds, and any interest earned thereon, which are equitably shared with participating law enforcement agencies.
 
Reason for Recommendation:  Receipt by the Department of Justice of the signed Equitable Sharing Agreement and Annual Certification Report is a prerequisite to the Sheriff receiving any equitably shared cash, property or proceeds.
 
Action to be taken following Board approval:  The Chairman of the Board and the Sheriff will sign the Equitable Sharing Agreement and Certification and it will be sent to the Department of Justice.
