Title: Department of Transportation and County Counsel recommending the Board approve and authorize the Chair to sign Amendment II to Agreement for Legal Services 412-S1311 / 2700 between El Dorado County and Meyers Nave, A Professional Corporation, revising the firm’s name from Meyers, Nave, Riback, Silver & Wilson, for general advice and litigation representation, inclusive of eminent domain, concerning various Capital Improvement Program projects, with no other material changes. (4/5 vote required) FUNDING: Funding for various Capital Improvement Program and Environmental Improvement Program projects, will be provided by associated Federal, State, and Local funding sources. Local funding sources may include any combination of the following: Traffic Impact Fee Program, Missouri Flat Area Master Circulation and Financing Plan, Road Fund, Tribe Funds, Accumulative Capital Outlay, Developer Advanced Funds, Sacramento Municipal Utility District, and/or General Fund.

DISCUSSION / BACKGROUND
On December 4, 2012 (Item 7, Legistar 12-1440 v1), the Board authorized the Chair to sign the Agreement for Legal Services Between El Dorado County and Meyers, Nave, Riback, Silver & Wilson concerning the Silva Valley Interchange Project (Agreement).

On May 19, 2015 (Item 6, Legistar 12-1440 v2), the Board authorized the Chair to sign the First Amendment to the Agreement, expanding the Scope of Work to include “various public works projects”, including but not limited to three other Capital Improvement Program (CIP) projects: the Alder Drive at EID Canal Bridge Replacement Project (CIP 77123); the Sly Park Road at Clear Creek Road Bridge Replacement Project (CIP 77115); and the Newtown Road at South Fork of Weber Creek - Bridge Replacement Project (CIP 77122). Effectively, the First Amendment allowed for contracted work to be performed for any CIP project in progress.
