DISCUSSION / BACKGROUND

On June 22, 2021, the Board approved the District Attorney’s acceptance of the Cannabis Tax Fund Grant Program with the California Highway Patrol (CHP) in the amount of $192,500 for grant period July 1, 2021 - June 30, 2022. This is the District Attorney’s first award under this grant Program. The purpose of the CHP Cannabis Grant Program is to provide public outreach and education on the impacts of driving under the influence, increase Driving Under the Influence (DUI)/Driving Under the Influence of Drugs (DUID) enforcement efforts through the means of conducting thorough investigations, participate in DUI checkpoints, and administer training to local officers on investigative criteria related to DUI/DUID incidents.

 

The budgetary focus of this program is to fund one Limited-Term Investigator (District Attorney) (DAI) per the approval of enclosed Resolution xxx-2021 updating the District Attorney’s Personnel Allocation. This position is anticipated to be active for the duration of the grant program, or as long as funding is available. Should funding be renewed, the District Attorney’s Office will return to the Board to extend the Limited-Term position allocation. 

 

The Limited-Term DAI will support grant objectives on a full-time, 100% allocation basis. The DAI will be the liaison between the Deputy District Attorneys and agencies submitting arrest reports and will work to monitor cases submitted by agencies up to the filing standard in the court. After obtaining the necessary training and experience, this Investigator will also be able to testify as an expert in DUID cases. Through training, public outreach and education, it is the goal of the DAI to increase the number of DUID cases filed and, as a result, prosecuted by 5%. The cost associated with the Limited-Term DAI is approximately $175,000. The grant award also includes a 10% indirect cost rate in the amount of $17,500 to cover overhead costs that cannot be directly assigned to a specific project activity and are necessary to complete the project, such as office utility costs and administrative grant management costs.

 

ALTERNATIVES

Should the Board decline to approve the position request, the District Attorney's Office will be unable to effectively meet the CHP Program objectives.

FINANCIAL IMPACT

There is no change to Net County Cost associated with the Limited-Term District Attorney Investigator allocation request. The position will be completely funded by the CHP Cannabis Tax grant award. The increase in revenue and appropriations will be added to the department’s budget during the FY 2021-22 Adopted Budget process.
