DISCUSSION / BACKGROUND:

Welfare and Institutions Code (WIC) Section 5897 directs the State to implement the mental health services defined in the WIC Section 5800 (Adult and Older Adult Mental Health System of Care Act), Section 5840 (Prevention and Early Intervention Programs), and Section 5850 (The Children’s Mental Health Services Act) through contracts with county mental health programs or with counties acting jointly.  The Health and Human Services Agency (HHSA), on behalf of the County, contracts with the State to serve as the Mental Health Plan (MHP) for the County of El Dorado.

 

As the MHP, HHSA maintains contracts with multiple inpatient psychiatric hospital facilities to ensure the availability of inpatient services in order to meet the needs of those residents served in accordance with the MHP Agreement 3190 (17-94580) with the Department of Health Care Services, and per 42 Code of Federal Regulations Section 438.2. Sutter Valley Hospitals, doing business as Sutter Center for Psychiatry (SCP), is a not-for-profit psychiatric hospital in the Sacramento region serving children and adults. SCP’s prior Agreement 897 expired on December 3, 2018. SCP and the County started contract negotiations to renew that Agreement in late August of 2018, but were unable to complete the process before the contract’s expiration. The negotiations continued thereafter, however, yet an agreement was never finalized due to the COVID-19 emergency being declared. At that point in time, negotiations were put on-hold, before being re-initiated in early 2021. Agreement 5445 with SCP has a proposed term starting October 1, 2021 continuing through September 30, 2026, with a maximum obligation of $750,000.

 

In accordance with Board of Supervisors Procurement Policy C-17, Section 7.11, the contractor selection process for service contracts in excess of $100,000 must include a review of the scope of services and contractor’s professional qualifications by a group of individuals (including at least one representative from outside the department requesting the services) qualified to judge the contractor’s ability to perform the services.  HHSA has documentation on file that such a review was performed for Agreement 5445 with SCP.

 

ALTERNATIVES:

Should the Board decline to approve this recommendation, HHSA would only be able to continue to provide services through existing contracts with other vendors. This would limit HHSA’s capacity to serve residents that require these mandated services.

FINANCIAL IMPACT:

This Agreement for Services continues to be funded with State Realignment funding.  Contract Rates shall be at the rates established between SCP and the Host County (Sacramento).  There is no Net County Cost associated with this Agenda item.  Sufficient appropriations were included in the Fiscal Year 2021-22 Budget, and will be included in future budgets for the term of the Agreement.
