New rules enacted as part of the revised Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) require self-insured companies and insurance carriers to report electronically to the Centers for Medicare and Medicaid Services (CMS) any payments to a Medicare eligible claimant. The County of El Dorado is self insured for third party liability and workers compensation claims. The County uses outside companies to administer those claims. For third party claims, the County contracts with George Hills Company. For Workers Compensation claims, the County contracts with Gregory Bragg and Associates.

The new rules require that the County take certain actions prior to October 1, 2009 or the Responsible Reporting Entity (RRE) can be fined up to $10,000 per day. The County is a RRE. The following action must be taken prior to October 1, 2009:

1. Register with CMS’ Coordinator of Benefits Contractor to provide CMS with our notice of intent to report data.
a. Designate an Account Manager to be report the data.
b. Designate an Authorized Representative, who has the authority to bind the County to a contract and the terms of the MMSEA section 111 requirements. The Authorized Representative has ultimate accountability for the RRE’s compliance with Section 111 and cannot be an agent.

Recommendation:

It is recommend that the Director of Human Resources be designated as the Authorized Representative.
