Probation Department recommending the Board:
1) Accept funding per Award Letter dated May 26, 2021, from the California Department of Justice (DOJ) for necessary Supervised Release File System upgrades;
2) Delegate authority to the Chief Probation Officer, or designee, on behalf of El Dorado County, to execute Memorandum of Understanding 20-0017D with the DOJ California Justice Information Services Division for the retroactive term of January 1, 2021, to May 31, 2023, in the amount of $8,585.60, contingent upon County Counsel and Risk Management approval;
3) Delegate authority to the Chief Probation Officer, or designee, to sign certifications on invoices to receive reimbursement for activities; and
4) Authorize the Chief Probation Officer, or designee, to administer any subsequent administrative documents, including any required fiscal and programmatic reports.

DISCUSSION / BACKGROUND
On October 1, 2020, the California Department of Justice (DOJ) was awarded the Fiscal Year (FY) 2020 Sex Offender Registration and Notification Act (SORNA) Reallocation Grant to further sex offender registration and notification in California through submissions to the Supervised Release File (SRF).
The DOJ is aware that many counties lack funding to make the appropriate updates to send all supervision types, or to conform to new industry standard data file formats to electronically submit supervised release data. The SORNA Reallocation Grant will enable DOJ to reimburse local supervising jurisdictions in implementing an industry standard format to electronically submit sex offender data on post-conviction probation, mandatory supervision, post-release community supervision, and all other types of supervised release. These technological enhancements will improve the exchange and data integrity of sex offender registration and notification information at both the state and federal levels.
Funding from the FY 2020 SORNA Reallocation Grant will be used to reimburse the Probation Department (Probation) for necessary updates to comply with new SRF requirements, mandated by Penal Code section 14216(c), effective January 1, 2021. Probation received the MOU from DOJ on September 15, 2021. Work to upgrade Probation’s systems will be performed beginning in September 2021.
ALTERNATIVES
Supervising jurisdictions must comply with the new SRF reporting requirements as mandated by Penal Code (PC) section 14216(c). Without Board approval, the DOJ cannot reimburse Probation for the cost of system upgrades.

FINANCIAL IMPACT
The MOU will allow Probation to further sex offender registration and notification in California through enhancement of submissions to the SRF System. No matching funds are required from the County in connection with this MOU. Costs associated for the upgrades will be funded on a reimbursement basis. The MOU funding directly offsets the General Fund cost of these projects.
There is no increase to Net County Cost. This is a revenue MOU.
