Transportation Department recommending the Board authorize the Chairman to sign the Notice of Acceptance with A. Teichert & Son, Inc., dba Teichert Construction, for the Asphalt Concrete Overlay 2009 - Lotus Road Project, Contract No. PW 09-30416 (CIP Project No. 72177) in Lotus.

FUNDING:  This Project was funded with American Recovery and Reinvestment Act of 2009-Regional Surface Transportation Program funds.
Body
Reason for Recommendation:
The Contract for the Asphalt Concrete Overlay 2009 - Lotus Road Project (Project) on Lotus Road from Wunschel Lane to SR-49 in Lotus was approved by the Board on August 25, 2009.  The Project was completed on October 21, 2009.  Execution of the Notice of Acceptance will start legal time frames for guarantees, a lien period and return of retention monies.

The construction budget for this Project, as reflected in the Transportation Department's (Department) 2009 Capital Improvement Program, was $1,025,000.  The total estimated cost of this Project is listed below:

Original Bid Price                                        $1,203,195.20
Estimated Construction Contract Item Cost            $1,183,253.70
Estimated Contract Change Order                        $     20,000.00
Estimated Final Cost of Construction Contract      $1,203,253.70

The costs listed above are estimates because the Department is still working with Teichert Construction to finalize the Project's costs.  The Department does not anticipate that the costs listed above will change significantly.

The Contract Change Order on this Project dealt with performing remedial work at each approach to the Weber Creek Bridge.

Action to be taken following Board approval:
1)  The Chairman will sign the Notice of Acceptance.
2)  The Board Clerk will send the Notice of Acceptance to the Recorder/Clerk's Office for recordation and forward a copy of the recorded Notice of Acceptance to the Department.
