Department of Agriculture, Weights and Measures recommending the Board approve and authorize the Chair to sign the Lease Agreement by and between the Counties of Plumas, El Dorado, and Placer, leasing a weight truck and weight equipment to Plumas County.

DISCUSSION / BACKGROUND

The Department entered into an agreement with Placer County on March 10, 2009 (Legistar Item # 09-1283) to pay $20,000 toward Placer County's purchase of a 26,000-Pound Gross Vehicle Weight Rating, two-wheel-drive, flatbed weight truck, at a total cost of approximately $100,000. El Dorado owns fourteen (14) 1,000 pound certified weight standards and a motorized weight cart. Pursuant to a lease agreement, each county currently uses the weight truck, weight standards, and cart an average of four to six weeks per year for the specialized testing/inspecting of commercially used vehicle, winery, livestock and large capacity shipping and receiving scales. El Dorado County, while retaining ownership of the Weight Standards and Cart, granted Placer the right to keep, store and use the Weight Standards and Cart in conjunction with the Weight Truck. This agreement currently runs through March 10, 2024.

 

In Section two and three of the lease agreement, Placer and El Dorado acknowledged and agreed that to reduce the costs to each jurisdiction of the use and maintenance of the Weight Truck and Weight Standards and Cart, both jurisdictions would jointly pursue lease opportunities with other local counties. Placer and El Dorado have identified Plumas County as a Third-Party Jurisdiction and desire to lease the Weight Truck and Weight Standards and Cart. The MOU attachment is for limited use by Plumas County of the truck for Fiscal Year 2022-23 year for the testing of livestock and large capacity shipping and receiving scales. The lease payment in the amount of $3,000 will be paid to Placer County.

 

ALTERNATIVES

Per the agreement, this type of attachment is allowed through the period of March 10, 2024, however the Board could choose to not approve this recommendation. The Department is reviewing this document as the signature request is to acknowledge the use between Plumas County and Placer County.

 

PRIOR BOARD ACTION

On March 10, 2009 the Board of Supervisors approved a one-time payment and a 180-month agreement for the usage of Placer County's new weight truck and the use of El Dorado County's weights and weight mover (Legistar item #09-0283). On September 28, 2021 the Board approved Amador County to use the Weight Truck (Legistar item  #21-1428).

FINANCIAL IMPACT

None. The lease agreement requires maintenance costs to be paid by Plumas County. The lease payment in the amount of $3,000 will be made to Placer County.
