Health and Human Services Agency (HHSA) recommending the Board:
1) Make findings that the provision of skilled nursing and rehabilitation facility services provided by the contractor are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(B), El Dorado County Charter, Section 210(b)(6), and/or Government Code Section 31000;
2) Approve and authorize the Chair to sign Agreement for Services 6353 with GHC of Auburn, LLC doing business as Siena Skilled Nursing and Rehabilitation Center, with a not-to-exceed (NTE) amount of $3,300,000, and for a term effective upon execution through July 31, 2025; and
3) Authorize the HHSA Director or the Behavioral Health Director to execute further documents relating to Agreement 6353, contingent upon approval by County Counsel and Risk Management, including amendments that do not increase the maximum dollar amount or term of the Agreement.
FUNDING: 100% State Mental Health Realignment.

DISCUSSION / BACKGROUND:
The Health and Human Services Agency (HHSA) contracts with the State as the Mental Health Plan (MHP) for the County. As the MHP, HHSA is required to provide specialty mental health services to eligible individuals, including long-term residential facility placements when appropriate. To meet this requirement, the MHP contracts with long-term residential treatment facilities and other facilities, to ensure availability of services on an “as requested” basis, in accordance with Title 9, California Code of Regulations (CCR), Title 22 CCR and Welfare and Institutions Code (WIC), Division 5.
GHC of Auburn, LLC, doing business as Siena Skilled Nursing and Rehabilitation Center (Siena) is licensed by the California Department of Public Health as a Skilled Nursing Facility (SNF). A SNF is required to provide 24-hour skilled nursing care, as well as related or rehabilitative services. The typical resident is a person who is chronically ill or recuperating from an illness or surgery and needs regular nursing care and other health related services.
While HHSA contracts with other facilities that provide SNF services, there is still a need for an increased availability of SNF beds to meet community needs. HHSA is seeking approval to enter into Agreement 6353 with Siena for eligible County clients on an “as requested” basis.
In accordance with Board of Supervisors Procurement Policy C-17, Section 7.11, the contractor selection process for service contracts in excess of $100,000 must include a review of the scope of services and contractor’s professional qualifications by a group of individuals (including at least one representative from outside the department requesting the services) qualified to judge the contractor’s ability to perform the services. HHSA has documentation on file that such a review was performed for Agreement 6353 with Siena Skilled Nursing and Rehabilitation Center.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA would continue to provide services through existing contracts. This would leave HHSA unable to provide an increased amount of services, and County residents that require these services would receive them in a less timely manner.

FINANCIAL IMPACT:
There is no Net County Cost associated with this Agenda item. Sufficient appropriations were included in the Fiscal Year 2022-23 Budget, and will be included in future budgets for the term of the Agreement.
