Chief Administrative Office, Facilities Division, recommending the Board:

1)  Make findings pursuant to Ordinance Code, Section 3.13.030(a), El Dorado County Charter, Section 210(b)(6) and/or Government Code Section 31000 that services provided by Jani-King of California, Inc. under Agreement for Services 6378 are in the public's best interest, and the work can be more economically and feasibly performed by an independent contractor than County employees;

DISCUSSION / BACKGROUND

On May 20, 2022, the Purchasing Agent executed Agreement for Services 6378 with Jani-King of California, Inc. to provide routine janitorial services at the El Dorado Hills Senior Center for a term of two years and a not-to-exceed amount of $75,000.

 

Amendment I revises the contract term from May 20, 2022 through May 19, 2024 to April 1, 2022 through March 31, 2024.  Miscommunication and delays with obtaining authorized signatory information from the vendor created a gap in services that couldn’t be avoided.  Services were still needed during this timeframe due to continued program use and senior activities and the County is currently unable to pay for services provided during the month of April and part of May. 

 

Other changes to the agreement include ancillary updates to Safety, Indemnity, and Insurance clauses.

 

It’s recommended the Board make findings pursuant to Ordinance Code, Section 3.13.030(a), El Dorado County Charter, Section 210(b)(6) and/or Government Code Section 31000 that such services provided by Contractor are in the public's best interest, and the work can be more economically and feasibly performed by an independent contractor than County employees.

 

ALTERNATIVES

Should the Board decline this retroactive Agreement and Notice to Proceed the County shall be unable to pay the Contractor for services rendered during this time-frame.

FINANCIAL IMPACT

Agreement for Services 6378 has been budgeted in Fiscal Year 2021-22 and Fiscal Year 2022-23 and will be budgeted for in subsequent Fiscal Years.  There is no change in Net County Cost.
