DISCUSSION/BACKGROUND

An El Dorado County Rogue Jet Boat operated by the Sheriff's Office was damaged in a storm on Lake Tahoe in September 2021. In November of 2021, the Sheriff’s Office, Risk Management, and the County’s insurance company, Ascot Insurance Company (Ascot), agreed to an initial estimate of $37,875.18 for repairs. Because of supply chain delays, repair work was delayed.  Once repairs commenced, additional damage was found by the Vendor, JBT Marine. As is customary for these type of boat programs in California, authorization for the additional repairs was requested from the California Division of Boating and Waterways inspector and was subsequently authorized by said inspector.  Upon completion of the repairs, in May 2022, El Dorado County was presented with a final invoice of $48,989.03.  Our insurer, Ascot, did not agree with the additional work that was performed, and because it was not pre-authorized by El Dorado County or Ascot, Ascot is only offering the original estimate amount less a deductible of $1,000 for a total of $36,875.18 in their subrogation/release agreement. Funding to cover the difference in insurance to final invoice repair cost of $12,113.85 is available through the Sheriff’s Office State Boating grant for Fiscal Year 2021-22.

Risk Management is requesting the Board authorize the Risk Manager to sign the subrogation and release agreement issued by Ascot.
