DISCUSSION / BACKGROUND

A request has been submitted by Aria Dehqanzada and Jennifer Dehqanzada, Husband and Wife as Joint Tenants, owners of Assessor's Parcel Number 109-470-020, requesting that the County of El Dorado, Board of Supervisors, vacate a portion of the 100’ Wide Non-building Easement, labeled on the Subdivision Map as a 100’ Wide Non-building Setback, located on said property. The portion of the easement to be abandoned is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

 

The 100’ Wide Non-building Easement, labeled on the Subdivision Map as a 100’ Wide Non-building Setback, as shown on Lot 57 of Royal Equestrian Estates Unit No. 2, recorded in Book I of Subdivisions at Page 75, was offered to the County of El Dorado by Royal Equestrian Estates, A Limited Partnership, on June 6, 2000.  The easement was acknowledged by the County of El Dorado on August 15, 2000, and the Subdivision Map was recorded on August 16, 2000.

 

ALTERNATIVES
An alternative would be to not adopt the Resolution of Vacation for Abandonment of Easement 22-0003. By utilizing this alternative, the owners of Assessor's Parcels 109-470-020 would be unable to pursue any development that would impact the subject easement.

 

PRIOR BOARD ACTION

OTHER DEPARTMENT / AGENCY INVOLVEMENT

Department of Transportation, has not used said portion of subject easement for the purposes for which it was dedicated and find no present or future need exists for said portion of subject easement and do not object to it’s vacation, and to that end, has issued a letter to that effect.

 

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor's Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Jane McClusky.
