Health and Human Services Agency (HHSA) recommending the Board:
1) Make findings that the provision of residential care facility services provided by Kentfield Estates Ranch Residential Care Facility for the Elderly, LP are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(B), El Dorado County Charter, Section 210(b)(6), and/or Government Code Section 31000;
2) Approve and authorize the Chair to sign Agreement for Services 6821 with Kentfield Estates Ranch Residential Care Facility for the Elderly, LP, with a not-to-exceed amount of $200,000, for the term of three (3) years from October 1, 2022 through September 30, 2025; and
3) Authorize the HHSA Director, or the Behavioral Health Director, to execute further documents relating to Agreement 6821, contingent upon approval by County Counsel and Risk Management, including amendments which do not increase the maximum dollar amount or term of the Agreement.
FUNDING: 100% by State Realignment.

DISCUSSION / BACKGROUND:
The State of California Department of Health Care Services (DHCS) requires a Mental Health Plan (MHP) in each county to be responsible for providing or arranging for the provision of Specialty Mental Health Services (SMHS) to Medi-Cal beneficiaries in their County. The Health and Human Services Agency (HHSA) contracts with the DHCS as the MHP provider for the County of El Dorado and has the obligation to provide eligible County residents with access to long-term residential treatment facilities.
In this role, HHSA contracts with as many long-term residential treatment facilities as possible in order to ensure the capacity and availability of services to clients on an “as needed” basis. To meet the demand for client placements, HHSA contracts with facilities in and out of the County, as bed availability is limited and may result in long wait times for client admissions.
On October 15, 2021, the County Purchasing Agent approved Agreement for Services 6083 with Kentfield Estates Ranch Residential Care facility for the Elderly, LP (KER-RCFE), a licensed Residential Care Facility for the Elderly (RCFE), for the provision of twenty-four (24) hour care and rehabilitation services to assist clients with mental disorders, in the amount of $75,819 for a term of October 15, 2021, through September 30, 2022. During this term, KER-RCFE has provided reliable and quality services to County clients in accordance with the Agreement.
HHSA is recommending the approval of Agreement for Services 6821 with KER-RCFE for a three (3) year term from October 1, 2022, through September 30, 2025, in the amount of $200,000. The proposed Agreement 6821 will ensure the continuation of necessary RCFE services without any service interruption.
In accordance with Board of Supervisors Procurement Policy C-17, Section 7.11, the contractor selection process for service contracts in excess of $100,000 must include a review of the scope of services and contractor’s professional qualifications by a group of individuals (including at least one representative from outside the department requesting the services) qualified to judge the contractor’s ability to perform the services. HHSA has documentation on file that such a review was performed for Agreement 6821 with Kentfield Estates Ranch Residential Care Facility for the Elderly, LP.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA would continue to provide services through contracts with other vendors. HHSA would, however, be limited in its capacity to provide RCFE services, and clients currently receiving services from KER-RCFE will experience a disruption in the continuity of care. This would likely result in placement to a higher level of care, up to and including a Mental Health Rehabilitation Center/Institution for Mental Disease.

FINANCIAL IMPACT:
This Agreement for Services is a renewal of a prior year agreement and is funded by State Realignment funding, therefore, there is no Net County Cost associated with this Agenda item. Sufficient appropriations were included in the Fiscal Year 2022-23 Budget, and will be included in future budgets for the term of the Agreement.
