Body

DISCUSSION / BACKGROUND

The SCOE operates the Sly Park Environmental Education Center (Sly Park) in El Dorado County which provides outdoor science learning experiences in El Dorado National Forest to thousands of elementary school students every year. Students stay at Sly Park for a week-long or weekend program, raising important safety considerations for student participants and staff. The SCOE has requested these supplemental services in recognition of the importance of keeping Sly Park safe and are committed to putting forth their best efforts to achieve that goal.

El Dorado County Sheriff’s Office has committed to ensuring a safe environment for all students, staff, and citizens at Sly Park and will respond to calls regarding Sly Park safety concerns. The Sheriff’s Office will actively investigate and resolve violations of the law whether on or off campus, particularly acts which jeopardize individual safety. When it is deemed appropriate, Sly Park will be informed of criminal activity that can reasonably be expected to impact Sly Park and its students. This MOU provides for approximately 10 hours per month of active patrol of the area, on-site interactions, staff training, and a dedicated liaison. For its services, the Sheriff’s Office will be reimbursed a total of $10,000 for the annual school year.

California Government Code § 53069.8 provides the board of supervisors of any county may contract on behalf of the sheriff of that county to provide supplemental law enforcement services to:

(1) Private individuals or private entities to preserve the peace at special events or occurrences that happen on an occasional basis.

(2) Private nonprofit corporations that are recipients of federal, state, county, or local government low-income housing funds or grants to preserve the peace on an ongoing basis.

(3) Private entities at critical facilities on an occasional or ongoing basis. A “critical facility” means any building, structure, or complex that in the event of a disaster, whether natural or manmade, poses a threat to public safety, including, but not limited to, airports, oil refineries, and nuclear and conventional fuel powerplants.

(4) Private schools, private colleges, or private universities on an occasional or ongoing basis.

In addition, California Government Code § 6502 allows the governing bodies of two public agencies to enter into an agreement to jointly exercise any power common to the contracting parties.  This would include agreements in which the Sheriff agrees to provide supplemental law enforcement services to another public entity, including cities, special districts, and school districts.
