DISCUSSION / BACKGROUND

The Board is being asked to exclude the Assessment Appeals Board (AAB) from having to hold their meeting in a hybrid model.

 

The hearings are evidentiary in nature, and the best way to provide arguments to the AAB is in person. The AAB currently does not have protocols in place for conducting remote hearings and absent such protocols, it could be challenging and confusing when introducing documents into evidence on the day of the hearing and making the evidence available to all the parties for viewing in real time independent of the screen sharing during direct and cross examination of witnesses.  The AAB does not fall under the Ralph M. Brown Act.

 

Furthermore, many hours of staff time are dedicated to preparing for an AAB hearing and the Assessor's Office takes the hearing proceedings seriously. Requiring property owners and/or their agents to appear in person adds a heightened level of commitment to the proceedings which benefits all parties involved. Due to the nature of the Assessment Appeal hearing process it is appropriate to exclude the AAB from requiring them to hold their meetings in a hybrid model.

 

ALTERNATIVES

The Board could require the Assessment Appeals Board to comply with the hybrid model.
