DISCUSSION / BACKGROUND
On April 5, 2016 (Item 2, Legistar 16-0189 v1), the Board made findings in accordance with Ordinance 3.13.030 that it was more economical and feasible to retain an outside consultant for the provision of traffic engineering and transportation planning services, awarded Request for Proposal 16-918-046 to DKS Associates (DKS) to provide such services, and authorized staff to negotiate Agreement 402-S1611 (Agreement) with DKS with a term commencing upon execution and expiring three years thereafter, with a not-to-exceed amount of $150,000.
On May 23, 2017 (Item 17, Legistar 16-0189 v2), the Board approved Amendment I to the Agreement, increasing funding by $189,075 for a new not-to-exceed amount of $339,075, with no change in the rates or term of the Agreement, in order to provide traffic analysis forecasting and transportation planning services to prepare the Cameron Park Drive Interchange Alternatives Analysis and the Pleasant Valley Road Corridor Systemic Safety Analysis Report.
On March 12, 2019 (Item 12, Legistar 19-0285), the Board approved Amendment II to the Agreement, increasing funding by $250,000 for a new not-to-exceed amount of $589,075 and extending the contract for three years to March 24, 2022. Additional tasks performed under Amendment II included peer review of traffic impact studies, development of an Intelligent Transportation System (ITS) Voluntary Contribution Program, Carson Crossing Drive Intersection traffic analysis, and additional intersection analysis for White Rock Road at Bailey Circle.
On March 15, 2022 (Item 14, Legistar 22-0306), the Board approved Amendment III to the Agreement, extending the contract’s term for three years to March 24, 2025, to continue work on existing projects and provide ongoing peer review of traffic impact studies, as well as on-call traffic analysis and transportation planning services. The Amendment also included an updated rate sheet with no changes to the contract’s not-to-exceed amount.
Amendment IV to the Agreement increases funding by $200,000 for a new not-to-exceed amount of $789,075 to enable continued use of the contract for ongoing peer review of traffic impact studies, as well as on-call traffic analysis and transportation planning services. The amendment also updates the contract’s liability language and includes disclosures required under California’s Levine Act, which went into effect after the previous amendment was executed. There is no change to the contract’s term, rates, or scope.
ALTERNATIVES
The Board could choose not to approve Amendment IV. However, doing so could result in delays in traffic analysis forecasting and transportation planning services on the various tasks listed above.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. Funding for Amendment IV will be provided by development project applicants, traffic impact fees, and the Road Fund.
