Title: Sheriff’s Office recommending the Board: 1) Find that, in accordance with Section 3.13.03(b) of the El Dorado County Ordinance Code, the work requires specialty skills and qualifications not expressly identified in County classifications; 2) Authorize the Chair to sign retroactive Agreement 7596 in the amount of $80,000 with ABE Arens Brothers Environmental Inc., for hazardous materials removal and remediation services for the term August 1, 2022 through July 31, 2027; and 3) Authorize the Purchasing Agent to increase the Agreement on an "as needed" basis and execute further documents including future amendments during the awarded period as long as funding is available within the requesting department's budget. DISCUSSION / BACKGROUND
In August 2022, the Sheriff’s Office needed to have materials that have been contaminated with hazardous battery acid removed in an environmentally friendly manner. At the time, the Sheriff’s Office did not have a contract in place and per County policy services related to removal of hazardous materials require a contract regardless of the monetary value of the agreement. Therefore, this agreement is retro-active to include the dates of those services provided and will be ongoing for a term of 5 years.

Since that time, conversations have been ongoing with ABE Arens Brothers Environmental Inc. to determine appropriate costs for other items that need to be removed during the length of the agreement. This includes materials housed in the Brian Ishmael Shooting Range, the Property/Evidence Unit, and Sheriff’s Office Communications Unit. Given the multiple uses of this agreement, it was determined that a 5-year contract would be beneficial to County in order to keep prices consistent and provide guidance for budgeting in the future.

ALTERNATIVES
The Board could choose not to approve this retroactive agreement and direct the Sheriff’s Office to find alternatives.
