Title

Health and Human Services Agency (HHSA) recommending the Board:

1) Find that the provision of Mental Health Services Act (MHSA) Prevention and Early Intervention (PEI) and Community Services and Supports (CSS) services provided by the contractors are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(B);

2) Waive the competitive bid process for the agreements over $100,000 in accordance with County’s Procurement Policy Section 3.4.2(f), Exemption from Competitive Bidding, as these providers provide critical knowledge, including the possession of the required staff and facilities, and to ensure continuity of these budgeted services, in alignment with the Fiscal Year 2023-24 through 2025-26 MHSA Three Year Program and Expenditure Plan;

3) Approve and authorize the Chair to sign renewal Agreement for Services 7661 with CASA El Dorado for the MHSA CSS Court Appointed Special Advocate Project, in the amount of $69,000, for the term of three years from July 1, 2023, through June 30, 2026, with the option to extend the term of the Agreement for one additional year for a term not to exceed June 30, 2027, for a total maximum obligation of $92,000;

4) Approve and authorize the Chair to sign renewal Agreement for Services 7647 with Pioneer Union School District for the MHSA PEI Primary Project, in the amount of $159,000, for the term of three years and three days from June 27, 2023 through June 30, 2026, with the option to extend the term of the Agreement for one additional year for a term not to exceed June 30, 2027, for a total maximum obligation of $209,000;

5) Approve and authorize the Chair to sign renewal Agreement for Services 7637 with Black Oak Mine Unified School District for the MHSA PEI Primary Project, in the amount of $339,000, for the term of three years from July 1, 2023, through June 30, 2026, with the option to extend the term of the Agreement for one additional year for a term not to exceed June 30, 2027, for a total maximum obligation of $452,000;

6) Approve and authorize the Chair to sign renewal Agreement for Services 7659 with Lake Tahoe Community College Foundation for the MHSA PEI TimelyCare Project, in the amount of $120,000, for the term of three years from July 1, 2023, through June 30, 2026, with the option to extend the term of the Agreement for one additional year for a term not to exceed June 30, 2027, for a total maximum obligation of $160,000;

7) Authorize the Purchasing Agent to execute amendments relating to these agreements, contingent upon approval by County Counsel and Risk Management, which do not increase the maximum dollar amounts or terms of the agreements; and

8) Authorize the HHSA Director, or Director of Behavioral Health to execute programmatic, administrative, and fiscal documents relating to these Agreements.

 

FUNDING:  100% State Mental Health Services Act.

DISCUSSION / BACKGROUND:

In 2004, California voters passed Proposition 63, the MHSA, which imposes a one (1) percent tax on personal income in excess of $1,000,000.  The funds from the tax are distributed to California counties and are intended to transform the Mental Health System into one that is consumer and family driven, recovery-oriented, accessible, culturally competent, and offers services appropriate for the population that is served.

 

MHSA requires counties to develop a three year program and expenditure plan, known as the MHSA Three-Year Program and Expenditure Plan (Plan). The Plan has five components intended to address specific goals for priority populations and other key community mental health needs. The components are Community Services and Supports (CSS), Prevention and Early Intervention (PEI), Innovation (INN), Workforce Education and Training (WET), and Capital Facilities and Technology Needs (CFTN). 

 

Three-Year MHSA Plans are developed with input from community members and stakeholders through a public planning process, providing opportunities for community organizations and stakeholders to provide the framework for the plan's priorities by discussing mental health policy, program planning, implementation, monitoring, quality improvement, evaluation, and budget allocations

 

On June 20, 2023, the Three-Year MHSA Plan for Fiscal Year (FY) 2023-24 through FY 2025-26 was brought before the Board for adoption (23-0933). The provision of all of the services included in the agreements requested for approval were included in the budgeted service components in this MHSA Plan. The CSS and PEI services in these agreements include outreach to families, employers, primary healthcare providers, and within the local community to recognize the early sign of potentially severe and disabling mental illnesses, access and linkage to medically necessary care provided by mental health programs for children and adults with severe emotional disturbance, reduction in stigma associated with either being diagnosed with a mental illness or seeking mental health services, and reduction in discrimination against people with mental illness.

 

Agreement Summaries

1) Renewal Agreement 7661: CASA El Dorado will deliver Court Appointed Special Advocates to youth clients by implementing CSS strategies for youth and families who are at risk of involvement with or involved in the child welfare system and/or juvenile justice programs. CASA El Dorado has been providing these services for the County since 2019 under prior executed Agreements.

2) Renewal Agreement 7647: Pioneer Union School District will provide MHSA PEI Primary Project mental health services to students in this elementary school district in transitional-kindergarten through third grade through this agreement. This Contractor has recently implemented these services for the County under a prior executed agreement.

3) Renewal Agreement 7637: Black Oak Mine Unified School District will provide MHSA PEI Primary Project mental health services to students in this elementary school district in transitional-kindergarten through third grade. This Contractor has been providing these services for the County since 2016 under prior executed agreements.

4) Renewal Agreement 7659: Lake Tahoe Community College Foundation will be contracted through this agreement to administer the MHSA PEI TimelyCare Project. The TimelyCare Project is an Early Intervention program that provides treatment to address and promote recovery and related functional outcomes for a mental illness early in its emergence. Students enrolled at this college, through their TimelyCare application, will have upgraded access to the TimelyCare telehealth application to schedule and attend one-time or ongoing mental health appointments. This Contractor has been providing these services for the County since 2020 under a prior executed agreement.

 

HHSA recommends the Board approve and authorize execution of the above agreements to ensure that these MHSA PEI Projects and services, which were included in the MHSA Three-Year Plan and budgets for Fiscal Year (FY) 2023-24 through FY 2025-26, can be provided in the County.

 

Under the County of El Dorado Board of Supervisors Procurement Policy C-17 Section 3.4, HHSA recommends with El Dorado County Chief Administrative Office Procurement and Contracts Division concurrence, that competitive bidding requirements be waived for exemption reason (2(f)) “the procurement is for goods/services where the continuity of providers will provide efficiency or critical knowledge, and other providers cannot provide similar efficiencies or critical knowledge.” The agreements with Pioneer Union School District, Black Oak Mine Unified School District, and Lake Tahoe Community College Foundation are for services specifically targeted for students and therefore the schools/college itself is best suited to provide the services, where no other vendor is able to provide similar efficiencies, critical knowledge, and access to students.

 

ALTERNATIVES:  Should the Board decline to approve these recommendations, HHSA would continue to provide MHSA PEI services through existing contracts; however, HHSA will be out of compliance with the FY 2023-24 through 2025-26 MHSA Plan, and California Proposition 63.

FINANCIAL IMPACT:

There is no Net County Cost associated with the agenda item. These agreements are renewals of prior year agreements and continues to be funded with MHSA funding and budgeted in the MHSA Three-Year Plan for FY 2023-24 through 2025-26.  Sufficient appropriations were included in the Fiscal Year 2022-23 Budget and the 2023-24 Budget and will be included in future budgets for the term of the Agreements. 

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain signature of Chair on the original Agreements for Services (Nos. 7661, 7647, 7637, and 7659); and

2) Clerk of the Board to return these fully executed Agreements to the HHSA Contracts Unit at 3057 Briw Road.
