Title

DISCUSSION / BACKGROUND:

HHSA has contracted with California Department of Health Care Services (DHCS) for County-Based Medi-Cal Administrative Activities (CMAA) since 2014. CMAA assists in the proper and efficient administration of the Medi-Cal Program by improving the availability and accessibility of Medi-Cal Services to Medi-Cal eligible and potentially eligible individuals and their families. 

 

CMAA activities include, but are not limited to, attending or conducting general, non-medical staff meetings, developing and monitoring program budgets and/or site management, and general non-program supervision of staff.  This also includes staff break time and any time spent filling out a Time Survey Form, Medi-Cal Outreach, Referral, Coordination, and Monitoring of Medi-Cal Services, Facilitating Medi-Cal Application, Arranging and/or Providing Non-Emergency, Non-Medical Transportation to a Medi-Cal Covered Service, Contract Administration for Medi-Cal Services, Program Planning and Policy Development for Medi-Cal Services, Medi-Cal Administrative Activities (MAA)/Targeted Implementation Training, general administration, and paid time off.

 

On April 9, 2020, HHSA executed DHCS revenue Agreement 20-10005 (6443), for the term of July 1, 2020, through June 30, 2023, with a maximum obligation of $2,250,000, which the Board approved via Resolution 058-2020 (File ID: 20-0384). This revenue agreement outlines the County’s responsibilities to perform CMAA on behalf of DHCS.

 

Subsequently, DHCS requested that HHSA sign a new perpetual Program Participation Agreement EDC 7567 with a retroactive start date of July 1, 2020, that upon execution, will abandon and terminate the current Agreement 20-10005 (6443).

 

DHCS stated that the reason for the Agreement’s retroactive start date is to ensure that this new Agreement is effective as the same date of the original agreement 20-10005 which is being superseded. Due to some overlap between years covered by contract number 20-10005 (6443) and new Agreement EDC 7567, there are HHSA invoices outstanding that the DHCS intends to pay under this new agreement. Consequently, this Participation Agreement is retroactive to 2020 to avoid a “payment gap” in the agreement between DHCS and HHSA.

 

ALTERNATIVES:

The Board could choose not to approve the perpetual Program Participation Agreement EDC 7567 retroactively effective to July 1, 2020, thereby hindering HHSA’s ability to provide timely CMAA on behalf of DHCS, thereby limiting HHSA and DHCS’ ability to fund Medi-Cal Administrative Activities. If the retroactive agreement is not approved by the Board, HHSA’s Office of Public Guardian may lose the ability to reclaim Medi-Cal reimbursement of approximately $50,000.

FINANCIAL IMPACT:

There is no Net County Cost associated with this Agenda item.  Sufficient revenue and appropriations were included in the Fiscal Year 2023-24 Budget and will be included in future budgets for the term of the Agreement.
