Chief Administrative Office, Procurement and Contracts Division, recommending the Board:
1) Authorize the Purchasing Agent to execute a change order to Purchase Contract 5380 to authorize assignment of Hunt & Sons, Inc. to Hunt & Sons LLC to provide on-call Diesel Fuel and Winterization Additive for Countywide use as per the terms and conditions of Formal Bid 21-405-003; and
2) Authorize the Purchasing Agent to execute any necessary amendments relating to Purchase Contract 5380, excluding term extensions and increases to the not-to-exceed amount, contingent upon approval by County Counsel and Risk Management.
FUNDING: General Fund for Facilities Generator Fuel Tanks (Categories IV &V) (5%). Road Fund Discretionary for the Department of Transportation for maintenance equipment and vehicles (Categories I, II, & III) (90%). CSA 10 Funding for Environmental Management Generator Fuel Tank (Category VI) (5%).

DISCUSSION / BACKGROUND
In 2020, the Chief Administrative Office, Procurement and Contracts Division conducted a formal bid on behalf of Department of Transportation, Environmental Management Department, and the Chief Administrative Office, Facilities Division for the purchase of on-call Diesel Fuel and Winterization Additive.
On December 8, 2020, with Legistar Item 20-1535, the Board authorized the award of Formal Bid 21-405-003 to the low qualified bidder, Hunt & Sons, Inc. of Placerville, CA for the purchase of Diesel Fuel and Winterization Additive. On May 1, 2023, the County received a letter asking for consent to assignment of Purchase Contract 5380 to Hunt & Sons LLC, a Delaware limited liability company to become effective on or around July 1, 2023.
ALTERNATIVES
The Board could choose to not approve the recommended assignment, which could cause this purchase contract to become null and void and requiring this commodity to be re-bid. Rejecting this recommendation would cause the inability to: (1) operate equipment/vehicles used for road maintenance and snow removal, (2) operate equipment and generators used at the Union Mine Septage Plant, and (3) provide emergency power generation for various County maintained facilities, causing unsafe road conditions, and compromising the ability of County workers to perform their duties.
