DISCUSSION / BACKGROUND
AB 505 introduced by Assembly Member Ting on February 7, 2023 and as amended on 8/14/23, introduces substantial changes to key elements of the Senate Bill (SB) 823 (2020) Division of Juvenile Justice realignment framework. AB 505 adds several considerable new requirements not included in the SB 823 framework, which represent significant state and local costs and weaken county oversight. The new requirements create new mandated elements in the Division of Juvenile Justice realignment framework, change the frequency of subcommittee meetings and submission of the plan, add additional ombudsperson responsibilities including annual site visits from state agencies, and several other changes. In addition, the provisions in AB 505 could cause potential funding delays for juvenile justice programs.

Agencies such as the California State Association of Counties (CSAC), the Urban Counties of California (UCC), the Rural County Representatives of California (RCRC), the Chief Probation Officer of California (CPOC), and multiple counties throughout the state have written letters of opposition to AB 505.

The Probation Department requests the Board take a position of opposition to AB 505 and co-sign an opposition letter with the Chief Probation Officer.
