DISCUSSION/BACKGROUND
In accordance with the Board of Supervisors Procurement Policy C-17, Section 6.3 Surplus Property Sale or Transfer, "The Purchasing Agent shall sell, transfer, donate, or exchange surplus property as provided for by Government Code, County Ordinance Code, or Board of Supervisors' direction."

At the December 5, 2023 meeting, the Board designated a 1990 Ford F350 Truck (County Tag #32572) as surplus to the County's needs. Government Code, Section 25372 et seq. provides the authority for the Board to donate or lease any real or personal property that it declares to be surplus to any public agency or organizations exempt from taxation pursuant to Section 501(c)(3) of the Internal Revenue Code that is organized to provide health and human services.

In early November 2023, Chris Whitaker of Gilmore Hero Foundation, a non-profit 501(c)(3) organization, reached out to Supervisor Hidahl to request that the County donate the truck to the Gilmore Hero Foundation. County Counsel reviewed the mission of the organization and determined that it meets the requirements of Government Code Section 25372(b)(5) and plans to utilize the truck for health and human services activities.
