Background: Solid waste disposal can adversely impact Californians in many ways. Properties on which solid waste disposal occurred can lose economic value and create public health, safety and environmental problems. Many such properties have been abandoned or have owners who are unable or unwilling to pay the costs of cleanup. This program provides financial assistance in the form of reimbursement grants to help public entities accelerate the pace of cleanup, restore sites, and turn today's problems into tomorrow's opportunities.
 
The State of California enacted Assembly Bill 2136 that authorizes the California Integrated Waste Management Board to initiate and administer a program for cleanup of solid waste disposal sites and for cleanup of solid waste at codisposal sites where the responsible party either cannot be identified or is unable or unwilling to pay for timely remediation, and where cleanup is needed to protect public health and safety or the environment.
 
Reason for Recommendation: On September 15, 2009 the Board of Supervisors granted the Environmental Management Department the authority to apply for the Solid Waste Disposal and Codisposal Site Cleanup Program Fiscal Year 2009/2010 grant funding for the Meyers Landfill. On November 23, 2009 the California Integrated Waste Management Board awarded the maximum matching funding of $750,000 to the County for remediation activities related to the Meyers Landfill final closure. The match for this project is achieved via closure expenditures funded through litigation settlement funds. The County will not proceed with grant expenditures until the litigation settlement is reached and the County has cash in hand to fund the match.  It is anticipated the construction of the Meyers Landfill cap and final closure will commence the summer of 2010. The grant term is December 1, 2009 through May 15, 2012.
 
Grant Agreement SWC29-09-1 has been reviewed and approved by County Counsel and Risk Management.
 
 
Action to be taken following Board approval: Director of Environmental Management to execute Grant Agreement SWC29-09-1.
