Not applicable; there is no compensation between the parties to this Agreement.

Reason for Recommendation:
Health Services Department, Mental Health Division (MHD) is required to provide mental health services that are identified in student Individual Education Plans (IEPs). The proposed agreement with the Black Oak Mine Unified School District addresses the arrangements for the provision of such services, including therapist qualification and clearance, coordination of services, ownership and confidentiality of records, etc. In addition, the District is agreeing to provide facility space at affected school sites as needed by the MHD therapists to conduct counseling sessions and other meetings associated with IEPs. Similar MOUs are in place with El Dorado Union High School District and Rescue Union School District where Mental Health therapists perform IEP related services at the school sites.

Mental Health Division (MHD) services referenced in this Agreement are funded from a variety of revenue sources based upon the eligibility of the client and the services required by the student's IEP, including Medi-Cal, EPSDT, and AB 3632 (through the SB 90 claim).

This agreement covers the period of March 30, 2010 through June 30, 2012.

Action to be taken following Board approval:

1. Chairman to sign two (2) original Agreements.
2. Board Clerk's Office to return one (1) original Agreement to the Health Services Department, Mental Health Division.
3. Mental Health Division to distribute as appropriate.
