County Counsel recommending the Board authorize the Chair to sign an Agreement for Legal Services with the law firm of Scharff, Brady and Vinding for representation of the County in the cases of Sayegh v. County of El Dorado, et al., El Dorado County Superior Court Case No. 20100101, and Alto, LLC, a California Limited Liability Company v. County of El Dorado, et al., El Dorado County Superior Court Case No. PC20100104.

Background: These cases are two related challenges to the Board's approval of the La Canada project on January 19, 2010. On March 2, 2010, in closed session, the Board authorized defense of the actions and directed that we bring back a contract for Board approval with the law firm of Scharff, Brady and Vinding to represent the County in these cases. The project approval contains a provision calling for the project applicant to indemnify the County in the event of any challenge to the project approval. So the County will not incur any out-of-pocket expenses as the result of this contract.
Action to be taken following Board approval: County Counsel will supervise the work of outside counsel in handling the case.
