Fiscal Impact/Change to Net County Cost:
This Agreement will increase revenue for the Transportation Department's (Department) Tahoe Engineering Division's Erosion Control Program. There is no net cost to the County General Fund associated with this agenda item.
 
Reason for Recommendation:
The subject Agreement provides for the transfer to El Dorado County (County) of 25% of the gross income from California Tahoe Conservancy (CTC) leases to private individuals or groups on lands owned by the CTC in the County. Pursuant to Government Code Section 66908.3, the CTC is authorized to lease acquired lands. When such lands are within the County and are leased to private individuals or groups, the CTC must transfer twenty-five percent (25%) of the gross income of the leases to the County each year. The subject Agreement is the mechanism that accomplishes this transfer. Pursuant to the Budget Act of 2006, Chapter 47-06, the Legislature has appropriated $3,805 to the CTC for transfer to the County as private lease revenue for this fiscal year. At least fifty-percent (50%) of this amount is to be used for soil erosion control projects in the Lake Tahoe region, as defined in Section 66905.5 of the Government Code. All the funding provided by the previous Lease Revenue Agreement was used for soil erosion control projects, and the intention is to again allocate the entire $3,805 to soil erosion control projects.
 
The Agreement includes the requirement that the County sign the Contractor Certification regarding non-discrimination, drug-free workplace requirements, and other provisions for which certification is required when doing business with the State of California. The County's current practices are consistent with these requisites.
 
The term of this Agreement is retroactive from December 1, 2009 through June 30, 2010. The Department did not receive the subject Agreement until recently and is now seeking the Board's approval to execute said Agreement.
 
Action to be taken following Board approval:
1. The Board Chair will sign five (5) originals of the subject Agreement and the Contractor Certification.
2. The Board Clerk will return all five (5) partially-executed original sets and a certified copy of the Minute Order to the Department for CTC review and approval.
3. Following CTC's approval, the Department will forward a fully-executed Agreement to the Board Clerk's office.
