Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with this Agreement.   This funding is a pass-through to treatment service providers and has been incorporated into the FY 2009-10 budget.

Background:  The Health Services Department, Public Health Division, in collaboration with the California Superior Court, County of El Dorado, oversees the Collaborative Justice Juvenile Drug Court Program.  This Program provides alcohol and drug treatment services for El Dorado County youth who are court-ordered to treatment.  Funding for this program is provided by the Judicial Council of California, Administrative Office of the Courts (AOC), with Superior Court serving as the fiscal agent.  The Superior Court contracts with the County (via this MOU 851-PHD0609), which in turn contracts with local non-profit treatment providers.  Activities provided by County staff to support this program are funded by the Comprehensive Drug Court Implementation (CDCI) grant.

Retroactive term:  This MOU 851-PHD0609 was originally drafted in June 2009 in anticipation of the funding Agreement between Superior Court and the AOC.  However, the Agreement between the Superior Court and AOC was not fully executed until January 2010.   At that time, the original draft MOU was finalized to ensure compliance with the terms and conditions of the funding Agreement, and was submitted for review and approval.  Upon signature and receipt from the Superior Court, the MOU was promptly submitted for the next available Board Agenda date.

Reason for Recommendation:  Superior Court has received funding for FY 2009-10 for the Collaborative Justice Juvenile Drug Court Program, and this MOU 851-PHD0609 provides the funding for these services.

Action to be taken following Board approval:
1.      Chair to sign three (3) Memorandum of Understanding 851-PHD0609.
2.      Board Clerk's Office to return two (2) fully executed MOU 851-PHD0609 to Department.
3.      Department to process documents as appropriate.
