Background:
 
On February 26, 2008 the Board of Supervisors did adopt such resolutions believing, as set forth on the goldenrod for the item, that we were doing an "adoption of resolutions - ratification of the 2007 California Fire Code as adopted by the individual fire districts within El Dorado County".  What I believe we did was adopt the individual districts ordinances which are similar but individualized.  Through this action we have complicated county permit processes, have exceeded what is allowed/required under the State Fire Code, and passed our authority of to the fire districts which is probably not legal.
 
Individuals may wish to review the agenda items #31 of May 19, 2009 (09-0348) and #21 of August 18, 2009 (09-0348), the latter being for our workshop wherein we passed the following motion:
            A motion was made by Supervisor Briggs, seconded by Supervisor
            Sweeney, to direct staff and Economic Development Advisory Committee
            to work with Cal Fire and Fire Districts to compile one set of comprehensive
            standards for the County.  Yes:  Knight,Sweeney,Nutting,Briggs & Santiago.
 
I believe from all I have read and from our workshop that the adoption of those resolutions was inordinate and possibly an inappropriate delegation of our authority.  Perhaps, the rescission of the resolutions will assist in accomplishing the direction given on August 18, 2009.
